1. Legal notice
In compliance with Law 34/2002 on Information Society Services (“LSSI”), notice is hereby given that the PROSEGUR GOLD website (hereinafter, the “Website” or the “Platform”) is managed and owned by “PROSEGUR CUSTODIA DE ACTIVOS DIGITALES, S.L.”, a commercial company incorporated under Spanish law, registered with the Commercial Registry of Madrid, Volume 40353, Page 80, Section 8, Sheet M-716843, entry 1, with Tax Identification Number (NIF) B88610126, and registered office at Calle Pajaritos 24, 28007 Madrid (Spain) (hereinafter “Prosegur Crypto”). 2. Acceptance of the terms of use
By accessing, browsing, or using the Website, the User (hereinafter also “You”) expressly accepts these Terms and Conditions of Use (hereinafter also the “Terms and Conditions,” “General Conditions,” or “Conditions”) in the version published at the time of access. If the User does not agree with these conditions, they must refrain from using the Website. Prosegur Crypto reserves the right to modify these conditions at any time by publishing such modifications on the Website; such modifications shall enter into force upon publication, and the date of modification shall always be indicated in the header of these Terms and Conditions. Users are advised to periodically review these Terms and Conditions.
Notwithstanding the foregoing, in order to access the Platform, the User must accept these Terms and Conditions, the Privacy Policy, and the Cookies Policy.
The PROSEGUR GOLD Website is part of the tokenized gold trading service, whose terms and conditions are available here and must also be accepted by the User prior to accessing the Website.
3. Purpose and scope
These general conditions govern access to and use of the PROSEGUR GOLD Website and/or Platform, through which users may create a personal account, manage gold tokens associated with that account, and consult, where applicable, information related to the services offered by Prosegur Crypto. These conditions apply both to individual users (natural persons) and to representatives of legal entities using the Website. Use of the Website is permitted exclusively for personal or internal corporate purposes, and any unauthorized commercial use or resale of the platform’s content or services is strictly prohibited.
4. User registration and credentials
To access the private area of PROSEGUR GOLD and manage gold tokens, the User must complete the registration process by providing true, accurate, and complete information. The User undertakes to keep their access credentials (username and password) confidential and not to share them with third parties. Any activity carried out through the User’s account shall be presumed to have been carried out by the User, who shall be responsible for such activity. The User must immediately notify Prosegur Crypto of any unauthorized use of their account or any security breach. Prosegur Crypto shall not be liable for any damages or losses resulting from the User’s failure to comply with this security obligation.
5. User obligations and rules of conduct
The User undertakes to use the Website diligently, properly, and lawfully, in compliance with applicable law, morality, public order, and these Terms and Conditions. In particular, the User agrees, by way of example and without limitation, to the following:
- Lawful use: Not to use the Website for unlawful, fraudulent purposes or effects, or in a manner that infringes the rights or interests of Prosegur Crypto or third parties, or otherwise contravenes these Conditions. The User shall refrain from any act that could damage, disable, overload, or impair the Website or prevent its normal operation.
- Accuracy of information: To provide truthful and lawful information when completing forms or interacting with the Website. Impersonating third parties or using false identities in any section of the Website, including the user account, is prohibited.
- Respect for third-party rights: Not to disseminate content through the Website that infringes third-party rights, particularly intellectual or industrial property rights, trade secrets, or personal data of other users without consent. The User shall also refrain from posting or transmitting any obscene, defamatory, abusive, violent, discriminatory, or hate-inciting content.
- Security and integrity of the Website: Not to intentionally introduce viruses, malware, malicious code, or other elements that may alter or damage Prosegur Crypto’s or other users’ information systems. Unauthorized access to private areas of the Website, Prosegur Crypto’s systems or servers, or other users’ information is prohibited.
- Non-commercial use: The User may not reproduce, duplicate, copy, sell, resell, or exploit for unauthorized commercial purposes any part of the Website or the services accessed through it. Use of the PROSEGUR GOLD platform is limited to personal use (for individual users) or internal management use (for legal entities), and does not entitle the User to commercialize the services, information, or content obtained through the Website.
Prosegur Crypto may temporarily or permanently suspend the account or access of users who breach these obligations or engage in conduct that interferes with the normal use of the Website by other users, without prejudice to any legal actions that may be applicable.
6. License of use
Prosegur Crypto, as the holder of the intellectual and industrial property rights to the Website and all its content (including, by way of example, texts, images, designs, software, source code, trademarks, logos, and databases), grants the User a non-exclusive, non-transferable, and revocable license to use the Website and its content solely for the purpose of accessing the services offered on PROSEGUR GOLD in accordance with these Terms. This license is granted to both natural persons and legal entities, exclusively for personal or internal use. Any unauthorized commercial use, distribution, public communication, modification, transformation, assignment to third parties, or decompilation of the Website’s content is strictly prohibited. Nothing in these Terms shall be construed as a transfer of intellectual or industrial property rights to the User. Access to the Website does not confer any ownership rights over protected elements, and the User undertakes to respect all intellectual and industrial property rights held by Prosegur Crypto. The extraction and reuse of all or a substantial part of the Website’s content without the express written consent of Prosegur Crypto is prohibited.
7. Limitation of liability
Prosegur Crypto makes its best efforts to ensure the proper functioning of the Website, free of errors and up to date, but cannot guarantee total availability, infallibility, or the timeliness of the content. Accordingly, unless otherwise required by law, Prosegur Crypto assumes no liability in the following cases:
- Availability and continuity: Prosegur Crypto does not guarantee uninterrupted or error-free access to the Website. Access may be temporarily suspended due to maintenance work, technical improvements, or causes beyond Prosegur Crypto’s control (such as internet service provider failures, power outages, external attacks, etc.). Prosegur Crypto shall not be liable for temporary unavailability of the Website or for any damages that may result therefrom.
- System damage: Prosegur Crypto does not guarantee that the Website, its servers, or its content are free from viruses, malware, or other harmful elements. It is the User’s responsibility to have appropriate tools for detecting and disinfecting harmful programs. Prosegur Crypto shall not be liable for damage to the User’s or third parties’ equipment resulting from browsing the Website.
- Reliability of information: Although Prosegur Crypto endeavors to ensure that the information and content published on the Website are accurate and up to date, errors, inaccuracies, or omissions may occur. Prosegur Crypto does not guarantee the truthfulness, accuracy, timeliness, or authenticity of the Website’s content. The User accesses and uses the information at their own risk. Prosegur Crypto shall not be liable for decisions made by the User based on the information provided on the Website, nor for any damages arising from such decisions.
- Use by the User: Prosegur Crypto shall not be liable for any damages, losses, or harm of any kind suffered by the User (or third parties) as a result of improper or unlawful use of the Website by the User. In particular, Prosegur Crypto shall not be liable for use of the platform for purposes other than those permitted, or for the User’s failure to comply with their obligations under these Conditions.
- Links to third-party websites: The Website may contain hyperlinks or links to third-party websites, which are provided solely for the User’s reference. Prosegur Crypto exercises no control over such third-party websites and is not responsible for their availability, content, products, services, or privacy practices. The inclusion of such links does not imply any association, merger, or participation between Prosegur Crypto and the linked third parties. The User accesses third-party content at their own risk and subject to the applicable terms of use.
In any event, Prosegur Crypto shall only be liable for damages caused by willful misconduct or gross negligence, and only to the extent required by applicable law. Mandatory consumer rights that cannot be waived by contract remain unaffected; however, to the extent permitted by law, any liability of Prosegur Crypto for direct or indirect damages is excluded.
8. Personal data protection
Any personal data collected through the Website or during the provision of services (for example, during account registration or token management) will be processed in accordance with Prosegur Crypto’s Privacy Policy, which is available on the Website.

Information about the cookies used by the Website and their characteristics can be found in the Cookies Policy.
10. Applicable law and jurisdiction
These terms of use are governed in their entirety by Spanish law. Any dispute arising from access to or use of the Website shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of the city of Madrid (Spain), unless mandatory law provides otherwise.
